Are you renting your property?

Where the lease requires Lessor’s Consent and / or Registration of each new Tenancy Agreement, you must ensure that you comply with this requirement within any time frame stipulated therein.

These requirements are contained within the lease so that the Lessor maintains an awareness of the current occupants and can ensure that any subletting arrangement complies with the lease and does not adversely affect the rights of any neighbouring owner.

We will write to you from time to time where your lease contains such a requirement.  We kindly ask that you complete one of our simple online forms so that we can update our records.

Our Requirements

We require the terms of the lease to be complied with in respect of all Consent and / or Registration requirements.  This means that we must be informed of each new Tenancy Agreement granted.  This includes new Tenancy Agreements with existing Tenants.

All subletting must be by way of an assured short-hold tenancy agreement, not less than six months and no more than three years.

Rolling Contracts

Where you allow an existing Tenancy Agreement to lapse and become a “Statutory Periodic Tenancy”, or “rolling” monthly contract, you should complete our Sublet: Exception Notification to provide this confirmation.

Sublet Certificate

Upon receipt of an online form, we will seek to register the Tenancy details on our database within five working days.

Once registration is completed, a Sublet Certificate will be uploaded into your Tenant Portal account. This completes our process and provides confirmation that we have registered your details. You can access your Certificates area here.

Please note: these fees are inclusive of VAT unless otherwise stated.

Sublet Exception

Where a Tenancy Agreement expires and becomes a rolling contract, this can be registered free of charge.

Offline Fees

Our offline fees are £140 for Initial Applications / Registrations and £85 for each subsequent tenancy agreement you sign.

Short-term holiday Let

Your lease will almost certainly contain a requirement for the property to be used for private, residential purposes only. Any short-term letting without granting an Assured Shorthold Tenancy Agreement will therefore be a breach of the lease.

Short term letting can be disruptive to neighbouring owners and can also increase the risk profile of the building where occupants are coming and going without becoming familiar with the health and safety procedures for the building.  Short term letting in breach of the lease can therefore lead to increased building insurance premiums or in extreme circumstances, invalidation of existing building insurance cover.

As a result of this, we will take all necessary steps to enforce any breach of lease which might affect the rights of neighbouring leaseholders. All costs associated with such action will be recovered from the defaulting leaseholder.

Please seek independent advice to understand the terms of your lease before considering any short term letting arrangement.

Buy to let Mortgage Applications

If any mortgage lender has asked for confirmation that the Lessor will permit Subletting at your property, including where you do not yet have a Tenancy Agreement to register, we can provide a simple confirmation that Subletting will be permitted, subject to certain conditions.

The main condition is that the subletting arrangement is permitted under the lease, and that where applicable, you register the Tenancy Agreement with us.

Our fee

We charge a one-off fee of £95.00 inclusive of VAT to provide such confirmation.  Please contact us here with any request.
